Have you been injured by a negligently operated big truck, tractor trailer, big rig or Mack Truck?

Usually when so much weight hits you, it hurts you. It's the roadway equivalent of a sledgehammer.

Here are some common causes of truck related accidents in Florida that an experienced lawyer has probably handled:

  • Large trucks spraying standing water to the side in a rain storm, causing bad visibility to cars alongside.
  • Unexpected and wide turns.
  • Lane changes without checking the blind spots. Where of course you are driving at some point alongside or to the rear in a blind spot and this should be anticipated by an experienced trucker.
  • Rapid and sight blocking lane changes, coming into your lane without proper signal.
  • Barreling down on you while you are at a stop light because the truck driver thinks you are going to start off the line more quickly.
  • Jackknifing or Jacknifed tractor, roll over.
  • Toxic spill or explosion due to improper fuel spill or tank puncture.
  • Backing without looking.

As a Florida Truck Accident Lawyer, I know that there are a lot of professional drivers on the road. I respect them highly, they are trying to make a living. They are away from home in the early morning and they have a lot of frustrating drivers on the road to deal with. With that said, there are also a lot of truck, dump truck, freight trucks and delivery vans out there where the driver is taking No-Doze or stimulants to stay awake. Those energy drinks and caffeine stimulants only last so long. Some of those truckers end up falling asleep behind the wheel. In my opinion, Florida is a long and tedious State to drive in, it is flat and the expressways are not very curvy, so Equipment Operators and Truckers can become sleepy a little easier. While we do not have snow or ice, we sure have a lot of downpours and road fog.

There are Federal rules and regulations governing and concerning how long a long distance trucker can stay behind the wheel. The driver of a big rig or truck has a special need to "beat the rap" when it comes to the ticket for careless poor driving, failure to yield right of way or otherwise causing a Florida accident.

Your lawyer knows and so should you, that when you make a claim or bring a lawsuit against a guy who uses his car for commuting to and from work and who was ticketed it is a very different case from when a trucker gets charged with an accident. First, the truck driver makes his living by driving. Second, any ticket the truck driver gets is a big threat to their living.

Some companies, employers and insurance companies will not hire a trucker with even a couple of tickets where the truck driver has been found guilty. So, many of these cases do not settle easily. As an experienced and board certified litigator, I can take the case all the way if I have to. The insurance companies know that.

I can respect and understand how important their good driving record is to them, but Justice is blind. You are entitled to expect, demand and get safe, reasonable driving from these professional drivers, and as a Florida truck accident lawyer I will fight for your legal right to get the maximum result and money compensation to which you may be entitled.

You can obtain a lot more information and free consultation, just give me a call. I look forward to hearing from you. If the case is large enough, the injuries serious enough, then I will consider cases in the Florida panhandle, Tallahasse, Gainesville, Eustis, Orlando, Ft. Myers, Port St. Lucie or elsewhere in the State of Florida.

There are a lot of facts to investigate when your truck accident lawyer considers the claim. He or she must assemble all the investigative details. Look up the driving record of the driver, as much as can be located about the company and its safety record. Was the equipment, the truck, in good working order? Did bald tires or overdue brake maintenance contribute to the accident? How heavy was the truck- full load, half capacity? Nowdays, many of the trucks have a GPS system that reports and tracks the vehicle movements. Was the trucker stopped near a strip club for three hours before your accident? Perhaps the records can be subpoened. Was the trucker on the cell phone? Same idea. Then, some of the cars and trucks on the road have "black boxes". Similar to airline cockpit black boxes, but without the voice. These boxes can hold information about speed, braking and other valuable data. Not every case can afford the royal work up, because eventually the costs of investigation may be charged to you from any settlement or recovery, so the truck accident lawyer needs to decide how and when to investigate the case and how much to spend. This should reasonably be discussed with you when you sign the retainer or soon thereafter.

A big piece of information to consider is driver visibility. Under most circumstances, distant forward visibility is far superior for the tractor trailer or big truck. The driver sits higher. This throne-like position is not so great when it comes to spotting pedestrians crossing close to the front end of the cab, or locating vehicles alongside. I often select accident reconstruction experts to review the line of sight or visibility as part of my overall review and considerations in any Florida truck accident claim.

Understand your legal rights. Call for a free consultation. Time delay in obtaining a lawyer can harm your case because there are time deadlines to file lawsuit, witnesses can move away and recollections can fade. Evidence can become stale. When you call my office you will be treated with respect and I speak plainly.

I look forward to your call.
